Terms and Conditions

Welcome to Pingendum ("Pingendum," "we," "us," or "our"), a CAD (computer-aided design) application developed and operated by Tiba Design Sdn. Bhd., a company registered in Malaysia ("TIBA Design"). These Terms and Conditions ("Terms") govern your access to and use of our website at pingendum.com (the "Site"), our waitlist, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement.

Pingendum is currently in active development. Access to certain features, including our waitlist, may be limited, modified, or discontinued at any time without notice. We do not guarantee that any specific feature or version of the Service will be released on any particular timeline.

The Service does not currently offer user accounts. Joining the waitlist requires an email address and nothing else; it creates no account, no login and no credentials.

You agree that the address you give us is one you are entitled to use, and that any information you provide is accurate.

If we introduce accounts, we will update these Terms before doing so. From that point you will be responsible for keeping your credentials confidential and for activity carried out under your account.

We may suspend or withdraw your access to the Service, including removing you from the waitlist, if you breach these Terms.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law
• Use automated means (bots, scrapers) to access the Service without our prior written consent

The Service — including its design, software, branding, and content — is owned by TIBA Design and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or brand assets.

Any designs, models, or files you create using Pingendum ("User Content") remain your property. We do not claim ownership over User Content you create.

Pingendum is a desktop application. The Service does not currently store or process your User Content — projects you create stay on your own device unless you choose to share them, and we receive no copy of them.

If we later introduce a feature that requires us to hold your User Content, such as cloud storage or sharing, you grant us a limited license to store and process it solely as necessary to provide that feature to you. We will update these Terms before introducing any such feature.

By joining our waitlist or creating an account, you consent to receive emails from us regarding product updates, launches, and related communications. You may unsubscribe at any time via the link provided in our emails.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, TIBA Design and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

We may modify, suspend, or discontinue the Service, or update these Terms, at any time. Material changes to these Terms will be communicated via the Site or by email where appropriate. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms.

These Terms are governed by the laws of Malaysia, without regard to conflict of law principles.
